COMMISSIONE RAPPORTI INTERNAZIONALI – CRINT

 

Il Consiglio dell’Ordine degli Avvocati di Torino segue con estrema preoccupazione la drammatica vicenda umana e giudiziaria che riguarda Patrick George Zaki, studente di origine egiziana, iscritto all’Università di Bologna ed arrestato all’aeroporto del Cairo a febbraio 2020.

Patrick George Zaki, sottoposto ad indagini, per quanto appreso da notizie giornalistiche, per reati di propaganda sovversiva, istigazione alla protesta e istigazione al terrorismo, è attualmente detenuto, in forza di una misura cautelare la cui durata viene prorogata ormai da oltre un anno. Ciò desta grande sgomento, poiché la reiterazione dei termini della misura cautelare, con proroghe che non si comprende se fondate su un accertamento del tutto presuntivo della pericolosità sociale, sovverte uno dei principi cardine del giusto processo e del diritto di difesa.  E di ciò non può che dolersi un Consiglio dell’Ordine degli Avvocati, investiti della funzione sociale di difesa dei diritti fondamentali.

Lo status detentionis di Patrick George Zaki rappresenta un grave e intollerabile vulnus delle convenzioni internazionali e dello ius cogens internazionale in tema di diritti umani che impone a tutti gli Stati, indipendentemente dalla sottoscrizione di uno specifico trattato, il rispetto dei principi e delle garanzie ontologicamente connesse ai diritti fondamentali della persona umana, presunta innocente o  condannata con sentenza definitiva, come il  diritto alla vita, alla incolumità fisica, alla dignità personale, all’accesso alla giustizia e all’equo processo.

Il COA di Torino, pertanto, nell’esprimere la propria vicinanza a Patrick George Zaki, ai suoi familiari, ai suoi amici studenti che lo sostengono indefessamente   e il proprio sgomento per la protrazione in quelle condizioni della sua libertà personale, auspica che la magistratura egiziana, nell’accogliere le istanze della difesa di Zaki, possa adottare tutti i provvedimenti più opportuni per ristabilire d’ora in avanti le garanzie procedurali del giusto processo anche nella fase preprocedimentale.

 

Si comunichi cortesemente alla Presidenza del Consiglio dei Ministri, al CNF, a tutti i Coa italiani,  ed al Ministero della  Giustizia.

The Turin Bar Association Council follows with extreme  concern the dramatic human and judicial case involving Patrick George Zaki, a student of Egyptian origin, enrolled at the University of Bologna and arrested at the Cairo airport in February 2020.

 

Patrick George Zaki, who has been investigated by news reports, for crimes of subversive propaganda, incitement to protest and incitement to terrorism, is currently in detention, under a protective measure the duration of which has now been extended for more than a year. This is a great shock because the repetition of the terms of the precautionary measure, with extensions that cannot be understood if based on a completely presumptive assessment of social danger, subverts one of the fundamental principles of due process and the right of defence. A Council of the Bar Association, invested with the social function of defending fundamental rights, can only regret this.

 

The status detentionis of Patrick George Zaki represents a serious and intolerable vulnus of the international conventions and of the international jus cogens in the matter of human rights which it imposes on all States, irrespective of the signing of a specific treaty, respect for the principles and guarantees ontologically linked to the fundamental rights of the human person, presumed innocent or sentenced by final judgment, such as the right to life, physical safety and personal dignity, access to justice and fair trial.

 

Turin Bar Association, therefore, in expressing its closeness to Patrick George Zaki, his family members, his fellow students who tirelessly support him and its dismay at the continuation of his personal freedom in those conditions, hopes that the Egyptian judiciary, in accepting the requests of the defence of Zaki, can take all appropriate measures to restore from now on the procedural guarantees of due process even in the pre-trial phase.
